EUDR instructions for Chinese Suppliers
The Deforestation Regulation (EUDR)(注) imposes new requirements on companies placing and/or supplying the EU relevant commodities e.g. wood and rubber or relevant products that have been produced using them such as paper products, and accessories made of natural rubber. The EUDR will apply from December 30, 2024.

Compliance of EUDR is required for all entities (Company) identified within the supply chain from initial harvest of wood/rubber down to the entity(company)responsible for importing those products into the EU market. Failure to comply could lead to exclusion as a supplier as, from 30th December, 2024, all products/commodities placed into the EU market must have an accompanying due diligence statement.

The EUDR will affect any natural or legal person who, in the course of business, places (imports) those relevant commodities or products on the EU market or supplies them to the EU market (for distribution, consumption or use). It will therefore concern a large number of entities (company)。

According to the EUDR, before placing (importing) or supplying selected products and commodities on the EU market, companies must ensure and demonstrate that their products do not cause deforestation, and they must provide a due diligence statement. The due diligence statement will need to be supplied to any downstream customers before the product or commodity is imported into the EU market*. The due diligence statement must include following information:

2. a quantity of the relevant products (entering the market)
a. in kilograms of net mass or quantity in net mass or volume or number of items
3. the country of production (and, where relevant, parts thereof)
4. the geolocation of all plots of the land
a. where the relevant commodities (that the product contain) are produced
b. date or time range of production (e.g. date of harvesting or duration of the production process)
c. if there are different plots of land used, the geolocation of each different plot is required
5. the name, postal address and email of any business, operator or trader from whom they have been supplied with the relevant products (upstream supplier)
6. the name, postal address and email of any business, operator or trader to whom the relevant products have been supplied (downstream customer)
7. conclusive and verifiable information that the relevant products are deforestation-free
8. conclusive and verifiable information that the relevant commodities are produced in accordance with relevant legislation of the country of production

For all customers, the above information is required to be verified and analyzed, and a risk assessment carried out. In the assessment at least the following must be taken into account:

1. the assignment of risk of the relevant country (low, medium, high: the EU Commission will do an assessment of countries, but before that every country is deemed to be a medium risk country)
2. the existence and coverage of forest in the country of production
3. the presence of native peoples in the country or region of production
4. the consultation and cooperation with indigenous peoples
5. any reasonable claims by native people based on verifiable information regarding the use or ownership of the area
6. prevalence of deforestation (or forest degradation) in the country of production or parts thereof
7. the source, reliability, validity and links to documentation of the information referred in the information requirements
8. concerns in relation to the country of production and origin or parts thereof
a. e.g. corruption, lack of law enforcement, violations of human rights
9. the complexity of the relevant supply chain and the stage of processing of the relevant products
a. especially difficulties in connecting relevant products to the plot of land where the relevant commodities were produced.
10. the risk of circumvention of EUDR or of mixing with relevant products of unknown origin or production in areas where deforestation or forest degradation is occurring/has occurred
11. substantiated concerns and information on history of non-compliance of operators or traders along the relevant supply chain with EUDR
12. information that would point to a risk that the relevant products are non-compliant
13. complementary information
a. e.g. certifications or other third-party verified schemes

In case the operator notices that the risk assessment highlights a risk of products being noncompliant, they must take procedures and measures that are adequate to achieve no (or only negligible) risk. Such measures may include, for example, requiring additional data, information or documents or independent surveys and audit. Operators must ensure adequate and proportionate policies, controls, and procedures are established to mitigate and manage risks of non-compliance of relevant products. These must include:
1. model risk management practices, reporting, record-keeping, internal control and compliance management
2. an independent audit function to check the internal policies, controls and procedures.
All information must be documented, and operators must be able to show documents to the competent authorities upon request.
*The entity that first imports the material into the EU market is responsible for notifying the EU traces system.
